Sukikoo Portal LLC ("Sukikoo," "we," "our," or "us") respects your privacy and is committed to protecting your personal data. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our mobile application, website, or interact with our services (collectively, the "Platform").

By using the Platform, you consent to the practices described in this Privacy Policy.

1. Information we collect

We may collect and process the following types of data:

  • Personal identification information: Name, email address, phone number, delivery address, Emirates ID or government-issued ID (for KYC verification).
  • Transactional information: Payment method, order history, service usage, and refund requests.
  • Device and technical data: IP address, browser type, device identifiers, app usage data, operating system, and language preferences.
  • Location information: When enabled, GPS and location data for logistics and delivery tracking.
  • Vendor business data: Trade license, business address, VAT certificate, and bank details (for vendor onboarding).

2. How we use your information

We use your personal data to:

  • Facilitate order placement, pickup, delivery, and tracking.
  • Verify identity and perform KYC checks.
  • Process payments and issue refunds.
  • Communicate with you via email, SMS, or push notifications.
  • Personalize your user experience.
  • Analyze usage to improve our Platform and services.
  • Fulfill legal, tax, and regulatory obligations.

3. How we share your information

We may share your information with:

  • Vendors who fulfill orders or deliveries.
  • Third-party service providers such as payment processors (e.g. Stripe), analytics services, and cloud hosting providers.
  • Law enforcement or regulatory authorities when required by law or to protect our legal rights.
  • Corporate affiliates or successors in the event of a merger, acquisition, or asset transfer.

We do not sell or rent your personal data.

4. Data storage and retention

Your data is stored securely on encrypted servers. We retain your personal information only as long as necessary to fulfill the purposes outlined in this policy, unless a longer retention period is required by law.

Transactional records (e.g., orders, invoices) may be retained for up to 6 years to meet legal, regulatory, and audit requirements. Marketing data is retained until you withdraw consent.

5. International data transfers

Your information may be transferred to and processed in countries outside the United Arab Emirates. By using our Platform, you consent to such transfers, provided appropriate safeguards are in place.

6. Your privacy rights under UAE law

Under UAE data protection law, you have the right to:

  • Know what personal data is collected and processed.
  • Request access to or correction of your personal data.
  • Request deletion of your account and associated data.
  • Withdraw consent for marketing communications.
  • Object to certain processing activities.
  • File a complaint with the UAE Data Office or a local data protection authority if you believe your rights have been violated.

9. Children’s privacy

Our Platform is not intended for individuals under the age of 18. We do not knowingly collect personal data from children.

10. Changes to this policy

We may update this Privacy Policy periodically. When we do, we will revise the “Effective date” and notify users through the Platform or by email where appropriate.

11. Legal basis for processing

We process your personal data based on one or more of the following legal grounds:

  • Your consent.
  • The performance of a contract (e.g., delivering your order).
  • Compliance with legal obligations.
  • Legitimate interests (e.g., improving services, fraud prevention).

12. Stripe payment processing

Payments on Sukikoo are processed securely via Stripe. When you provide payment information, it is handled directly by Stripe and not stored on our servers. Stripe’s privacy policy applies to all payment transactions.

13. Compliance with UAE data protection law

Sukikoo complies with the UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data and its implementing Cabinet Resolution No. 21 of 2022. We ensure appropriate safeguards are in place for lawful processing, cross-border data transfers, and user rights.

14a. Data Protection Officer (DPO)

Sukikoo may appoint a Data Protection Officer (DPO) to oversee compliance with data protection regulations. You may contact the DPO by emailing privacy@sukikoo.com.

14b. User responsibility

Users are responsible for maintaining the accuracy of their account information and for keeping their login credentials confidential. Sukikoo is not liable for unauthorized access resulting from user negligence or the sharing of login credentials.

15. Platform integrity and off-platform conduct

To maintain trust and security within the Sukikoo marketplace, Vendors and Users are strictly prohibited from exchanging personal contact information — including but not limited to phone numbers, email addresses, or social media handles — for the purpose of conducting transactions outside the Sukikoo platform.

Any attempt by a Vendor or User to bypass the platform to arrange direct services or payments will be considered a violation of these Terms and may result in immediate suspension or permanent removal from the Platform, at Sukikoo's sole discretion.

16. Vendor communication policy

To maintain integrity and ensure fairness across the Sukikoo Platform, Vendors are strictly prohibited from initiating or engaging in communication with Customers outside of Sukikoo's official communication tools.

This includes sharing or requesting phone numbers, email addresses, or any personal contact details with the intent of transacting outside the Platform.

Vendors must use only the in-app messaging system and Sukikoo-approved channels for all communications.

Any attempt to bypass the Platform to complete services, accept payments, or establish a direct business relationship with Customers outside of Sukikoo will be deemed a material breach of this Agreement.

Violation of this clause may result in the immediate suspension or termination of the Vendor's account and potential legal or financial consequences, including but not limited to repayment of onboarding costs, commissions lost, and damages to Sukikoo’s reputation and operational trust.
